It is also the punitive policy that determines the punishment and the manner in which it is applied and implemented, and it complements the criminalization policy, there is no punishment without prior criminalization of the criminal offence for which the penalty is due, which seeks to protect the fundamental interests of the survival and continuation of society, accordingly, the legislation stipulates the duties for which the offence is considered to have been infringed, the intentions for which the offence is punishable, and the legislation may vary in the amount of punishment it prescribes, so it is necessary to have a criminal policy for each State that may differ from other States.
